En noviembre de 1933, el contrabandista y financiero Juan March, preso por la Comisión de Responsabilidades del gobierno de la República desde junio del año anterior, se escapó de la cárcel dejando en ridículo a las autoridades republicanas. Con el escándalo de esa fuga, arranca El último pirata del Mediterráneo, biografía novelada del banquero mallorquín y feroz alegato político, publicado en 1934. Convertido en dueño y señor de la vida política española (lo mismo compraba periódicos que escritores o ministros), Juan March hizo todo lo posible por impedir la difusión de un libro en el que, pese a no aparecer con su verdadero nombre, se ponían al descubierto todas sus corruptelas e incluso su presunta participación en un crimen nunca del todo aclarado. No pudo impedir, sin embargo, que antes de la guerra se agotaran quince ediciones. La versión definitiva del libro, aparecida en 1937 y en la que los personajes y personajillos de esta crónica apasionante perdieron el transparente alias con que Manuel D. En este libro se aborda el complejo tipo básico del delito de tráfico de drogas contenido en el art.368 del Código Penal. La maestría de su autora para exponer la casi inacabable jurisprudencia sobre el art. 368, sin que la abundancia del material la abrume -al contrario, siempre la domina-, y su inteligencia para trazar las líneas por las que discurren y se bifurcan los numerosos problemas contenidos y las soluciones propuestas en las Sentencias del T.S.
Además, la disección que hace Joshi del tipo penal investigado teniendo en cuenta primordial, aunque no solamente, la jurisprudencia del TS, es en este caso, especialmente afortunada, pues el diluvio de resoluciones, sobre ese precepto hace que difícilmente pueda encontrarse un supuesto de hecho, por muy extravagante que éste sea- de cultivo, elaboración, tráfico, promoción, favorecimiento, facilitación o posesión de drogas que no haya sido objeto de examen en alguna sentencia, por lo que leer este libro equivale a conocer hasta en sus últimos detalles el contenido y los límites del art. 368.
